By accessing and using AcePath ("we", "our", or "us"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use this service.

2. Description of Service

AcePath is an online educational platform providing practice quizzes and preparation materials for NSW Opportunity Class (OC) and Selective school placement tests. Our service includes access to quiz sets, practice materials, and educational content designed to help students prepare for academic assessments.

3. User Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for:

• Keeping your password confidential and all activities that occur under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring your account information remains accurate and up-to-date

AcePath is intended for use by students with the involvement and consent of a parent or guardian. Accounts for students under 16 must be created and managed by a parent or guardian.

4. Acceptable Use

You agree not to use the service:

• For any unlawful purpose or in violation of any applicable federal, state, or territory laws of Australia
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, harm, defame, intimidate, or discriminate against any person
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To attempt to gain unauthorised access to any part of the service or its related systems
• To share your account credentials or allow others to access your account

5. Payment, Billing and Refunds

Some features of our service require a paid subscription. By purchasing a subscription, you agree to:

• Pay all charges associated with your chosen plan
• Provide current, complete, and accurate billing information
• Promptly update your payment information if it changes

All payments are processed securely through Stripe. We do not store payment card details on our servers.

Refunds: We do not generally offer refunds for change of mind once access to subscription content has been granted.

6. Intellectual Property Rights

The service and all of its content — including quiz questions, explanations, images, and materials — are the exclusive property of AcePath and its licensors, and are protected by Australian and international copyright law. You may not reproduce, redistribute, or commercialise any part of our content without our prior written consent.

7. Privacy

Your privacy is important to us. Our Privacy Policy and Cookie Policy explain how we collect, use, and protect your personal information, and form part of these Terms of Service.

8. Termination

We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms. You may also close your account at any time by contacting us. Upon termination, your right to access the service will cease. Subscription fees paid in advance are non-refundable except as required by the Australian Consumer Law.

9. Limitation of Liability

To the fullest extent permitted by law, AcePath and its directors, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including loss of data or educational outcomes. Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded.

10. Disclaimer

AcePath provides practice materials to assist students in preparing for assessments. We make no guarantee that use of our service will result in any particular outcome in OC or Selective school testing. Our content is provided in good faith on an "as is" basis.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice by email to registered account holders and by posting a notice on our website. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of AcePath after changes take effect constitutes your acceptance of the updated Terms.
